End User License Agreement — please read these terms carefully before using Whatsable services.
Automazing, LLC is the developer and sole owner of the digital platform Whatsable available at whatsable.app("Platform") including all intellectual property rights ("IP") comprised therein.
This End User License Agreement ("Agreement" or "EULA") is a contract between you ("End User" or "Subscriber") and Automazing, LLC, having its office at 18585 Coastal Highway Rehoboth Beach, DE, 19971 US.
By accessing or using Whatsable, you accept and agree to be bound by this EULA. If you disagree with any provision, you must immediately cease access to and use of Whatsable.
You hereby confirm, warrant and represent that you:
Subject to the End User's Warranties, Automazing hereby grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform upon purchasing any plan at whatsable.app/pricing.
This License is solely for accessing the Platform and using the Services in accordance with its intended functionality. You shall not sublicense, rent, lease, or otherwise transfer the Platform or any portion thereof to any third party.
You have the option to avail a free demo of Whatsable for a short and non-renewable trial period. The trial period shall end automatically and shall not convert into any paid Subscription unless you actively purchase such Subscription.
Prices and availability are at whatsable.app/pricing and are subject to change without notice.
All Subscriptions are renewed automatically for the same duration as the original Subscription Term using the payment method selected at purchase.
Unless mandated by law, paid Subscriptions are non-cancellable and non-refundable. No refunds or credits will be issued for partial periods of Service.
You confirm that you own all right, title and interest in and to the Media Content and End User Data. With respect to Personal Data, you are and shall remain the data controller and Automazing is and shall remain the data processor.
When you use Whatsable's AI services, both inputs and outputs are considered End User Data. You are solely responsible for evaluating and verifying AI-generated content before use.
Automazing does not warrant the accuracy, reliability, or completeness of AI-generated content and shall not be held liable for any errors, omissions, or potential harm arising from the use of such content.
In no circumstance shall Automazing be held liable for consequential, indirect, incidental, special, or punitive damages, business interruption, or loss of profits.
The sole liability of Automazing to you will be for direct damages, not to exceed the total Subscription Fee paid during the applicable period or USD 500, whichever is less.
Automazing owns all right, title and interest, including all Intellectual Property Rights, in and to Whatsable.
You may only use Whatsable as expressly permitted herein. Whatsable's name, logo, and product names are trademarks of Automazing.
12.1. The Agreement shall be governed by and construed in accordance with the laws of the State of Delaware.
12.2. In case of any issues or concerns, you may reach out to Automazing and we will make all reasonable efforts to resolve your issues amicably.
12.3. Any disputes that remain unresolved after 30 days shall be referred to arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
By accessing or using Whatsable, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
Automazing reserves the right to update or modify this EULA at any time without prior notice. Your continued use constitutes acceptance of the new EULA.
By accessing or using Whatsable, you agree that Automazing may contact you via the email address associated with your account for service-related notifications. You may opt out of non-essential communications by contacting team@whatsable.app.
